This Privacy Policy (“Privacy Policy”), as amended from time to time, governs the use by You of any online game, service or web site (collectively “Services” and each one individually, a “Service”), offered by Three Melons S.A. or any of its controllers, subsidiaries and affiliates (collectively “Three Melons”), and accessed through third party social networks (“Social Networks”).

When You use any of the Services, You agree to be bound by these Privacy Policy and the Terms of Service posted at http://www.threemelons.com/en/termsofservice (“Terms of Service”), which You accept without any objection, and also agree to be considered as a “User” (“User”). As a consequence, this Privacy Policy shall constitute a legal binding agreement between the User and Three Melons regarding the subject matter herein. The Terms of Service could be found at http://www.threemelons.com/en/termsofservice, and are an integral part of this Privacy Policy and incorporated into this document by reference.

Privacy of personal data is important to Three Melons. This Privacy Policy regulates the processing of personal data relating to the User and grants the User various rights in respect of User’s personal data. This Privacy Policy explains how Three Melons collects, uses and, in certain circumstances, shares any personal data the User provides by using the Services.

By using the Services, the User consents to the collection and use of User’s personal information (“Personal Information”) as outlined in this Privacy Policy

The User agrees that he will be considered to have been given notice of any modifications once Three Melons posts them to http://www.threemelons.com/en/privacypolicy and that his continued use of the Services after such notice shall be deemed an acceptance of any changes. As a consequence, the User agrees to: (i) check http://www.threemelons.com/en/privacypolicy periodically for new information and terms that governs his use of the Services; and (ii) read the direct messages sent by Three Melons with any revision or modification.

1.    COLLECTION OF PERSONAL INFORMATION.

1.1.    Three Melons gives the User a number of options regarding what information the User will give to Three Melons:

a)    When the User registers a profile with Three Melons, the User’s profile including any information (name, address, gender) will be registered with Three Melons.
b)    When the User identifies himself on a Three Melons site, the User may identify himself using a Three Melons account.
c)    When the User identifies himself on a Three Melons site, the User may identify himself through a Social Network account in which Three Melons may receive additional information about the User’s profile.

1.2.    In each case, Three Melons will collect and record the information the User has provided. Other than names and email addresses provided at User’s discretion, Three Melons don't generally collects any “Personal Information” about Users (such as social security number, telephone number, street address, drivers license number, etc.), exception being for billing and payments where Three Melons stores the User’s billing information such as name, street address, phone number.

1.3.    Three Melons may offer the User the opportunity to submit other information about the User (such as gender, age, occupation, hobbies, interests, zip code, etc.), or Three Melons may be able to collect that information from social networking systems on which the User have used the Services (in accordance with the terms of use of those systems), which would then also be covered by this Privacy Policy.

1.4.    In addition to information about the User, the User may choose to share information about the User in other content (“User’s Content”), such as in games. Any action the User performs with other players are considered public, and at the User’s own discretion.

1.5.    When the User uses a Service on the User’s social network page or on someone else's page, Three Melons may record information regarding the use of that Service, and Three Melons may collect other information that is visible on the User’s Social Network page in accordance with the relevant terms of use associated with that page. Since most Three Melons Services are served through Social Networks, it is the User’s responsibility to read and accept their Terms of Use, as well as Privacy Policy prior to continuing.

1.6.    When the User invites new members into the User’s network or sends messages through the Services, Three Melons collects and maintains on secure servers the information associated with those messages, including email addresses and content.

1.7.    Three Melons may use information about the User that Three Melons collects from other sources, including but not limited to newspapers and Internet sources such as blogs, instant messaging services, Three Melons games and other users of Three Melons, to supplement the User’s profile.

1.8.    Three Melons may contain links to other websites. Three Melons is of course not responsible for the privacy practices of other web sites. Three Melons encourages its users to be aware when they leave Three Melons site to read the privacy statements of each and every web site that collects personally identifiable information. This Privacy Policy applies solely to information collected by Three Melons.

1.9.    The User should also be aware that most content delivered through Three Melons games originates with another content provider. Such other content providers may place “cookies” on the User’s browser, or otherwise gather information about the User, including by asking the User to provide information through the site itself.

1.10.    Finally, in order to provide the best possible service and to allow Three Melons to make certain internal reports and make recommendations, Three Melons collects aggregate information about the use of the Services, including information about users accessing the Three Melons site or playing Three Melons games or using the Services on other sites, such as internet protocol addresses, browser type, browser language, referring / exit pages and URLs, other browser history, platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, the date and time, high scores, and any purchase the User shall made (“Activity Information”).

1.11.    By using the Services, the User consents to Three Melons retaining all the above-described information in anonymous form as long as Three Melons sees fit.

2.    CHILDREN. MINORS.

2.1.    Three Melons does not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register. If the User is under 13, please do not attempt to register for Three Melons or send any information about the User to Three Melons, including the User’s name, address, telephone number, or email address. No one under age 13 may provide any personal information to or on Three Melons. In the event that Three Melons learns that Three Melons has collected personal information from a child under age 13 Three Melons will delete that information as quickly as possible. 2.2.    Three Melons recommends that minors over the age of 13 ask their parents for permission before sending any information about themselves to anyone over the Internet.

3.    OTHERS INFORMATION.

3.1.    The User may decide to provide Three Melons with another person's email address so that person may be invited to join Three Melons or so that Three Melons may facilitate the User’s communication with other people through the Services (such as when the User uploads an address book).

3.2.    The User may also provide Three Melons with another person's contact information for purposes of delivering information through the Social Networks. Three Melons shall use this information to contact and, if necessary, remind that person that he or she has been invited to join Three Melons or receive content through the Social Network. All invitees are provided with the option not to receive further invitations from Three Melons. Three Melons may disclose such information if required to do so in order to comply with legal process, as described above.

4.    USE OF THE COLLECTED INFORMATION.

4.1.    Three Melons uses the User’s Personal Information to manage the User’s registration and to personalize the User’s use of the Services.

4.2.    Three Melons doesn’t sell or rent User’s Personal Information to any third party. Three Melons may, however, use certain information about the User that is not personal.

4.3.    Where the User has asked to receive information from Three Melons, Three Melons will use the User’s personal information to send the User newsletters or other information about Three Melons.

4.4.    Three Melons uses public information collected to determine the kinds of content that the User would like to view and to assist any advertisers in targeting their advertising. Three Melons may use aggregated information for the purposes of tracking website usage of the web site and in order to help Three Melons improve its website and for research and analysis purposes. The aggregate information and statistics will not, however, include details that can be used to identify the User.

4.5.    Three Melons also uses the User’s name, email address and other information on our system to notify the User of new product releases, Services notifications, and to solicit the User’s feedback and input. Those emails will contain an “unsubscribe” link should the User ever decides he does not want to receive further emails.

4.6.    The User understands and agrees that Three Melons may access, preserve, and disclose any information Three Melons may have about the User and the contents of the User’s account if required to do so by law or in a good faith belief that such access, preservation or disclosure is reasonably necessary to avoid liability, to comply with legal process, such as a search warrant, subpoena, statute, or court order, or to protect Three Melons’ rights and property, or that of Three Melon’s affiliates or the public. Three Melons is not required to question or contest the validity of any search warrant, subpoena or other similar governmental request that Three Melons receives.

4.7.    Three Melons may maintain copies of the User’s Content indefinitely, or delete certain User’s Content in whole or in part if Three Melons determines, in its sole discretion, that such Content constitutes an a posting in violation of the Terms of Service or for any or no reason.

4.8.    Three Melons also uses non-Personal Information and certain technical information about the User’s computer and the User’s access of the Services (including the User’s internet protocol address) in order to operate, maintain and manage the Services.

4.9.    Three Melons may disclose information about the User to its partners in order to provide the Services, resolve Services problems and correct errors in the Services, to communicate with the User about the Services, to provide the User with advertising and promotional information in connection with the Services, and to enhance the User’s experience on the Services. However, Three Melons does not give its partners an independent right to share this information. Due to Three Melons’ contractual obligations with these third parties and the need to share information to deliver and support the Services, Three Melons cannot provide the User with the opportunity to opt-out of sharing information (whether Personal Information or other information) with these third parties.

4.10.    Three Melons may also employ the services of a third party to help Three Melons provides its online services, such as processing any payments on its website. In some cases the third party may receive the User’s information. However, at all times, Three Melons will control and be responsible for the use of the User’s information

4.11.    Three Melons, certain of its partners, and each of their contractors and employees may view the User’s Content that the User transmits to the Services to provide the Services and otherwise perform the tasks set forth in this Privacy Policy.

5.    TRANSFER OF INFORMATION.

5.1.    Three Melons may transfer some of the User’s information outside Argentina in order to manage the User’s registration. Some of these countries may not have equivalent data protection legislation protection the use of the User’s Personal Information. 6.    COOKIES.

6.1.    A “cookie” is a text-only string of information that a website transfers to the cookie file of the User’s computer’s hard disk so that the website can remember who the User is. Three Melons’ system and the third-party advertising technology uses information derived from Activity Information, Three Melons’ cookies on the User’s hard drive, the User’s visits to Three Melons’ site, the Three Melons games that the User view and the Social Network you use to target advertising within the Services. In addition, Three Melons’ advertisers may use other third-party advertising technology to target advertising on the Services and other sites. In the course of advertisements being served to the User, a unique third-party cookie or cookies may be placed on the User’s computer. Similarly, third-party advertising companies may provide Three Melons with pixel tags (also called “clear gifs” or “beacons”) to help manage and optimize Three Melons’ online advertising. Beacons enable Three Melons to recognize a browser's cookie when a browser visits the site on which the beacon is located, and to learn which banner ads bring users to a given site. Three Melons does not have control of cookies placed by third parties.

6.4.    Three Melons does not provide any Personal Information to third-party advertising companies. Note, however, that if an advertiser asks Three Melons to show an advertisement to users with certain characteristics (for example, men ages 20-28) or a segment of that group (for example, women ages 30-34 who have viewed certain categories of content) and the User responds to that advertisement, the third-party advertising company may conclude that the User has the characteristics of the audience that they are trying to reach.

6.5.    Disabling/Enabling Cookies. The User has the ability to accept or decline cookies by modifying the settings in the User’s browser. 7.    LINKS TO THIRD-PARTY WEB SITES.

7.1.    Three Melons may contain links to other web sites. In addition, most content offered through the Services is served or hosted by other sites. These other sites maintain their own policies regarding cookies and the collection and use of personal information.

7.2.    These linked sites are not controlled by Three Melons and may collect date or solicit personal information from the User. To the maximum extent permissible by law, Three Melons is not responsible for such linked sites, content, business practices or privacy policies, or for the collection, use or disclosure of any information by those sites may collect. Three Melons provides such linked sites only as a matter of convenience and the inclusion of any link do not imply an endorsement by Three Melons of such linked sites.

7.3.    Three Melons encourages the User to review the privacy policies of those other web sites so the User can understand how they collect, use and share the User’s information.

8.    SECURITY.

8.1.    Three Melons takes appropriate precautions to protect our users' information. The User’s account information is located on a secured server behind robust firewalls. When the User enters sensitive information (such as credit card number or the User’s password), Three Melons encrypts that information using secure socket layer technology (SSL). Because email and instant messaging are not recognized as secure communications, Three Melons requests that the User shall not send private information to Three Melons by email or instant messaging services. 9.    SALE OF THE BUSINESS.

9.1.    Three Melons reserves the right to transfer the User’s Personal Information in the event of a transfer of ownership of Three Melons or the acquisition of substantially all the assets of Three Melons related to the business which collected such information, such as acquisition by or merger with another company. In such an event, Three Melons will notify users who have provided email addresses when information about those users is transferred and becomes subject to a different privacy policy.

10.    USER RIGHTS REGARDING PERSONAL INFORMATION.

10.1.    Right to Update.
